From what I understand, once the law comes in to affect, labor substitution will no longer be allowed so desi companies can't sell labors anymore. But the 2nd part of the puzzle was that approved labor will only be valid for X number of days (like 45 days as originally proposed) and I am not sure if this impacts the existing labors or not. 45 days expiration may only apply to new labors but no details has emerged yet so we'll have wait and see when the details come out. If it also applies to existing labors then we are home free because after the expiry date, all labors will automatically be canceled. Well, let's wait the for the fine details to come out first.
If this law does not apply to existing labors, we will still be in the same situation. BTW, what is a desi company. How come it can sell labors? Is selling labor legal?

I really like what you wrote and I think if baked by IV we can sign it as a petition and send it to explain our cause to the media and the American people that might not be aware of our situation.

Well, I used the pen tool and the circle shape tools (its a lot easier that way because you can drag the circle out from the center.. and you can find the center easily by using guides :) ) and they worked pretty good for me...

I am thankful to everyone who read or responded even if you don't agree. Taking it a step furthur there are couple of things that stand out which i think again show how we twist every fact to our advantage.
1) US need immigration to grow and prosper. wel agreed, but who are we to preach. Its for American to figure it out. We don't care for our mother land i:e India but we are first to point out how US will be worse off if it stops immigration. I really doubt the intention here. You know, we care more bout US then India and once we get our GC we probably wont care much bout US either.

I wouldn't bet on a month either. I think I'm the most unfortunate of people on the planet today :-(
My appointment was on the 12-Dec. Visa was approved immediatly but haven't received the passport yet. I receive the same response when I call.. that its under PIMS verification. No ETA of when I can expect it to be done..
I had a H1 transfer to a new employer and 3 year extension happen at the same time. I am not sure what the problem is and what I can do. I am totally stressed out and really depressed ..
If someone has done something thats helped their case move along.. please PM me or reply to this post.. Thanks !

How is that getting a citizenship is an achievement?
For that matter nothing is an achievement. if Some one gets a baby everyone greets him. Is that an achievement? If you buy a house you are happy. Is that an achievement? For some people coming to US was an achievement. Some people think getting a green card. We see all congratulation message when someone get his GC.
So Please be broad minded. It may be nothing for you. But for some people it is an achievement. People like me are happy by achieving small things. This may nothing for you But it is good reason for the celebration for the people like us.

I assumed that the EB3 numbers are split between India/China and ROW.
EB3-I could be as high as 40% - I could be wrong.
I would like to see some guru's comment on these numbers.

From the Perm Data there are aprox 21k perm Eb3 labor from 2005 to 2007.
2007 : 13K
2006 : 8k
2005 : 300.
So the rest 7K are BEC labor.

AFAIK, the GC job has to be a permanent full-time position and not a part-time position.
So much pain we are facing in this process. Hope all see their GCs come through fast.
My attoreny said GC is for full time position and it is very well supported if the employee is working full time with the sponsoring employer. I can easily imagine getting it filed in 3-4 places working part time or not even working. I guess we can run into problems if working part time. There is also a column somewhere in H1B visa application form where they ask "Did anyone sponsor you an immigrant visa". Not sure if that Question comes anywhere in the forms for GC, but if so, what does one write? A list of other employers.May not be a good idea, but its my personal opinion, and I dont have any observation on this

Guys lets face it, Currently we are up against a wall. This is absolutely THE worst time when it comes to immigration. We have to be quite careful about the kinda steps we take esp when it comes to immigration as the lawmakers have bundled us up as a banner of "immigrants".
Is there any pacca news on the date when the Senate take up this "immigration reform" bill? The extremely sad truth is that we can ONLY TRY. This is NOT in our hands and we have NO bargaining power here. That makes it all the more necessary that QGA guides us all the way and that we can pay for QGA all the way. A quick q to the gurus. Right now what is the status with QGA? I mean we have 30k they need 200k. So till we pay 200K they do nothing or are they doing this in steps like for 50K we take u to point A and for 50K more we take u to point B etc? Often my friends and people i talk to ask me that question and come up answerless :)
Please dont get me wrong, i m in NO way quitting or bringing people down, just keeping in touch with reality. :)

I agree. There haas to be a start. Like how Obama has promised he will make corporate CEOs accountable for the mess they create and move on, we must also jump start the community towards cleansing the system.
The CEO level corruption, if held accountable, we will see less of layoffs etc.. and we can see the good old days permanant jobs that are "really" permanant

I have been a IV member since 2006 . I have seen the ups/downs . donated money , sent letters , attended rallies and done whatever has been been proposed . But I see that many senior members who had the drive to motivate people are not sending or being part of any messages or threads at all and that is exactly why the movement seems to be losing steam .
The standard response that I see to any question is "have you donated money ? " . "Don't ask for anything till you have donated. " this is followed by some some red dots which normally works to silence the questions. People will be willing to donate when they believe in the movement . I remember we collected $ 30,000 in 1 month before the rally there was huge thread with all the donations . People were charged up and the money came up automatically . I am willing to donate but to be brutally honest I do not see the same level of motivation as was there in 2006 / 2007 days .Please use this as a wakeup call and not as reason to vent your frustration on me .
There are many senior members who I do not even see any more . Members joining in late 2007 or early 2008 will not know any of these guys .
Aman Kapoor . He is the founder of IV . I have not seen his messages since the past 3 years almost . Where is he ? Is it too much for him to send a greeting in New years eve motivating the members ? It takes just 2 minutes .

The others even I have forgotten completely.
The only leadership/core that I see is Pappu and no one else . If you have a country where the prime minister shows his face only once in 4 years , how are the people supposed to believe in that movement ? Please don't reply with a message saying what have I done or why can't I contribute money ? I have done that I am looking for leadership to show us the way and motivate us . All campaigns don't need money donations( Letters , calls , faxes etc ) . We could start with that and then drum up support and momentum and then the money will start flowing in automatically . There has to be a synchronized campaign organized by the leadership and all I see is everybody putting their eggs in the basket called spillover.

I've filed for my 140 with a substitute labor in July of 2007 under EB 3. The labour had a priority date in 2002.
My company has around 50+ employees and has been doing good from over 12 years. All the employees are being paid as promised from the start.
I joined the company in Jan of 2006 and was being paid in time and as promised from day 1.
There was an RFE raised on my 140 filed with substitution with rgrds to Ability to Pay. The proferred wage mentioned in the Labour was 75K and my company had the ability to pay in 2002, 2003 and 2004 based on their financial documents except for the year 2005.
In 2005 the company started a new division and hired several people, basically they were restructuring their company for the future and there net or gross whatever income was in -ve, They spent a lot of money on training, hiring etc.., which are reflected in their financial documents.
They were back too good numbers in 2006 and 2007 while i was working for them. In 2006 my W-2 show salary less then the proferred wage in the labour and at that point of time the company nor myself had any idea that we would substitute this X labour for me, But the companies numbers were good to support the difference of amount in 2006.
In the year 2007, i had a good hike, but was still below the proferred wage but only by 3K, and again the company had enuf finances to support the difference of amount.
Starting of 2008, i got another good hike and am way above the proferred wage.
Now the RFE was raised for Ability to pay from 2002 to current date, the current date being March 2008 when the RFE was raised.
My company submitted all the docs required and for the RFE and also clearly explained the reasons for the numbers being bad in 2005. They submitted my w-2's for 2006, 2007 and salary stubs for Jan and Feb of 2008 along with their tax returns, etc from 2002 to 2007.
Now the Response has been file on March 28th and am awaiting the decision, has anybody faced any similar situations and what could be the results you guys predict.
Would the USCIS consider only 2 months of my salary stubs in 2008 to qualify my case as being paid more than the proferred wage or would they scrutinize every other thing....

In 2005 the company started a new division and hired several people, basically they were restructuring their company for the future and there net or gross whatever income was in -ve, They spent a lot of money on training, hiring etc.., which are reflected in their financial documents.
They were back too good numbers in 2006 and 2007 while i was working for them. In 2006 my W-2 show salary less then the proferred wage in the labour and at that point of time the company nor myself had any idea that we would substitute this X labour for me, But the companies numbers were good to support the difference of amount in 2006.
In the year 2007, i had a good hike, but was still below the proferred wage but only by 3K, and again the company had enuf finances to support the difference of amount.
Starting of 2008, i got another good hike and am way above the proferred wage.
Now the RFE was raised for Ability to pay from 2002 to current date, the current date being March 2008 when the RFE was raised.
My company submitted all the docs required and for the RFE and also clearly explained the reasons for the numbers being bad in 2005. They submitted my w-2's for 2006, 2007 and salary stubs for Jan and Feb of 2008 along with their tax returns, etc from 2002 to 2007.
Now the Response has been file on March 28th and am awaiting the decision, has anybody faced any similar situations and what could be the results you guys predict.
Would the USCIS consider only 2 months of my salary stubs in 2008 to qualify my case as being paid more than the proferred wage or would they scrutinize every other thing....

If you are greened since Sept 1 - please vote and let all rest of our community know what worked for you or what did you do "special" to revive your case and get the much awaited approval this September.
This will give idea to other members to use the means to do the same and get the peace of mind you are experiencing.
