I remember the interim rule saying that:
- the process of labor substitution itself will be eliminated
- I-140 applications based on approved LCs (now, only in your name only) need to be applied within 45-days of LC's approval.
Does someone have the (official) link to this news that DOL has submitted this rule to OMB.
No, 45 days condition is not for "to file 140 within 45 days of labor approval"
But it is for the company to substitute the LC for some other employee within 45 days.
There is no time limit set to file I-140 for the employee for whom the LC was issued.

Hello there,
I called of them, took me less than 15 minutes. i am sure everyone else can call too. The selfish brats who have EAD's and are acting ignorant, remember if something goes wrong you could be stuck on EAD's for another 5- 10 years. The point is, we all as a highly skilled immigrants have an obligation to help ourselves and the ones who are stuck in this limbo till we get our GC.
You can either choose a piece of pie or take the whole cake home for your family and friends. Life is all about choices and a man is as good as his word. So give out your good word and help the others. 15 minutes that's it.

Yes, AFAIK the FB spillover is added to the base quota and then divided between the ranks. At least I hope DoS and USCIS don't mess up with this calculation.
BTW: Where were you able to find this information?
its clearly written in Sep'2008 bulletin. However, seems like EB3-I wont' get any of it and all numbers will be given to EB2. we loose again.

Thank you for the reply. When you say that if I go with Company A that there will be more scrutiny, do you mean they will check the vailidity of the offer and their ability to pay? I work for a Govt. Agency(Company C), they will give me an EVL but I am not sure if they will specify "in accordance with I140". I am actually doing the same job, same place, before as a contractor(Company A) and now as an Employee(Company C).
Either way is fine. Is company A willing to hire you, and you intend to join them when GC comes through? If so, send that letter. There might be alittle bit more scrutiny that way.
If you intend to stick with company C in the future, you can send the EVL of C and include a letter explanining you invoked AC21.
Its not an issue that your H1 transfer to C occured before the 485 filed by A. Once its past 180 days, you are free to work whereever you wish.

I totally agree with pcs and IamWithImmiVoice. Sounds like a deluge of letters to everyone that matters is one of the better ways to move ahead. Shall do that today itself. Would be great if a good number of us could do the same. As IamWithImmiVoice said very correctly, "Lets be all a part of the core team and not get an opportunity to say that the core team is not doing enough "

I think this is the best option today to make a lot of noise by writing letters and there is a good chance that he will take notice an d release the spill over.... It is very important to put proper subject in your e-mail. Please refer to the chennai consulate website for more information. Because of the volume of e-mails they'll be getting, they don't respond to normal e-mails. I got the response the next day. I don't know if i am a isolated case but it doesn't hurt to follow the instructions in the website.
The email response I got from consulate says following:

Our records show that because of the recent changes implemented in processing the H1b visas, your cases are being delayed. Your petition information has to be verified in the PIMS database before the visa could be adjudicated. It will take approximately another 5 more work days. Thank you for your patience.

Then I called the consulate officer and she told me that if I dont recieve passport by next Wednesday, then give a call. My case is not complicated..no issues with H1..no questions asked about my employer..just only about my spouse AOS..and I have AP, EAD which means they should have my background information already. I feel like I unnecessarily went to visa stamping. It is taking more than 2 weeks, after visa stamping, to get passport back..so going to India for 1 month vacation with visa plans is very risky..
Will let you know once i receive my passport.

Zoom, thanks for the initiative. Just wanted to make sure if there are any legality issues behind core accessing the IV funds for administrative costs. Because once we donate it to IV funds(unless there is a provision for them to access that money as reimbursement administrative cost) it may not serve the intended purpose.

Thanks Caliguy for all your help.
I was able to talk to IO in TSC. Very nice IO (male). He really took time to look into my case.
First he said my case is preadj. , Than he mentioned my I-140 is under EB3 as per computer records.
I told him, i have the copy of my approved I-140 and it is under EB 2 category. he put me on hold for like 4-5 minutes. Came back and said he has passed on the info to IO looking into my case . He asked me for Receipt,alien # ets. on my I-140 BUT God Darn it, i didint have the document with me at that time. He said, i could call, ad give it to IO . I was so MAD!!!
After 30 minutes of searching, i found my approved I140 from 2006.
I called POJ method Less than 2 minutes i spoke to IO ....they dont disclose the name.
I explained my situation again and gave him all the info .He even asked my contact phone no.
i gave it to him.
I dont know , what to do next. Do you think they really pass in the info to IO reviewing the case?
Should i call on Monday.
Man! this weekend will be a GRIND!
I wish , i had the I140 handy.
So all of you there,
Learn from my mistake...please have all the documents with you....you never know, what they will ask for.

Once I didn't have the receipts # for 140 (well, my lawyer never gave me a copy of 140 approval anyways, thankfully, I had created a case status update after filing in my portfolio, that is how I was able to "save" 140 receipts #'s forever) but , coming back to point, IO just read off the screen that company XXX filed your petition on date XXX and confirmed that there are two 140's.
Please fax your information to NCSC too as they do take a look at received faxes.

My impression from the description of the original poster, , which could be incorrect, is that the first 5 cars were at a stand-still or barely moving (due to traffic jam or red light); the OP or the 6th car hit the line from the behind. It is not about tailgating.
I am sorry, I should have worded it properly. My message was for people tailgating too close. On a rainy day, one of my friends skidded and hit a vehicle in front of him when it stopped suddenly, but he was the one given the ticket.

Masti_guy - Don't worry about not having an MS. If people with MS move out of the queue the queue will autmatically move forward. There are a number of MS engineers working in EB3 positions especially the one who have never changed employers after they got out of school..

Hardwork of immigrants is the bedrock of American society. If seen in that light it makes perfect sense. "We deserve," this thought also ties into the Pygmalion theory. That is the American way. This is not a collective but an individualistic society, unless you showcase your achievments they won't be fully acknowledged. Unless you show that you deserve nobody is going to give it to you.
On another note, I give my example, I changed my job last year and relocated. I don't work for a consultant either. My earlier priority date was Sept. 2002 but I was willing to make a move and not be held hostage to retrogression. I knew it would be tough and many of my friends on H1-B thought it was a bad decision. Atleast, now I won't regret not making a decision. This maybe an isolated example but my old employer hired two American workers to replace me. Maybe its because we work harder or maybe because its both, smarter and harder. As JFK said,"We want to go to the Moon not because it is eazy but because it is hard." We deserve as much as born citizens if not more based on our contribution to this great nation of immigrants.
