Why dont you call VFS and find out what's happening and if they can help you to resolve this?
I might have more information than VFS. The VFS agents don't know what's happening in the consulate. The agents doesn't know more than what is already present in the VFS website.

I talked to my lawyer about this. They have filed about 300 applications on July2'nd(reached USCIS on July 2). They haven't gotten a single application back. I think we can relax. July 2 applications are in the beginning of the queue and should get receptis after the june applications are done.

Looks like this Sheila is in her new avatar, from 3 year degree people trying to make $$$ in others troubles! She threatened to sue IVians for exposing her tricks when she tried to advt her service in her posts, as friendly posts.

Your comment reminded me of something I had penned down right after Prime Minister Manmohan Singh visit to the US. It was very depressing.
A White Collar Slave
Prime Minister Manmohan Singh�s visit to the White House was well reported in the media and the Presidents acknowledgement of the contributions made by the people of India- Indian American�s was most gracious. He also made a point to acknowledge the contributions made by Indian students to America�s Universities. All this is most heart-warming. However, as a legal non-permanent resident awaiting labor certification (or the ability to work) since the past 3 years I feel bound by invisible chains whose cold steel refuses to be warmed. The labor certification process is technically supposed to take 12 months.
Post 9-11, grinding to a near halt the labor certification process of permanent residency applicants is a �win-win� opportunity for the government. Get these highly skilled laborers on a short-term lease of an H1B. Pass off the bureaucracy and red tape of the INS on the process of Homeland security. The latest breakdown, the INS information technology system has been down for 6 weeks now. When asked questions about a status of the system, they donot respond
HIB visa holders make money in dollars that certainly affords them a higher income than would have been possible in their own country. I donot want to undervalue this benefit. But, the American government and citizens hugely profit from the brief stay of these H1B�s in America. H1B�s make money, 99% of which is placed in American banks, which enables banks to fund American projects of citizens and noncitizens. They buy American stock, pay into a social security system and a pension fund that the may not have access to when they themselves are seniors- after all the H1B is only for 6 years. Besides the obvious monetary contributions, they contribute culturally, linguistically and through charity to American society
While they are contributing in as many ways to the American society. Their own lives are in limbo. Continuously stressed over the next rule change in visa status that may affect them, or visiting relatives. Their able spouses unable to work due to visa restrictions. Most of them, live in clean, minimal living comforts as there is always the thought of having liquid cash as one may need to leave the country and then having expensive electronics, cars or furniture may not make any sense. For most of them it does not make sense to own a house on a 6-year work contract.
The opposing argument is that HIB visa holders are subjecting themselves to this lifestyle. After all there are no visible chains around their feet, they are free to return and contribute to the economy of their own countries. But the �American dream� is an invisible chain currently held by INS merchants as they pull, push or decide to hold steady their white-collar slaves.

even after entering US on Advance Parole.
Followup questions:
1. Is the I-94 # on your New H1B Approval same as the I-94 which you got
when you entered US on Advance Parole?
2. I am sure that your Attorney might have mentioned that last manner of

Why don't we all put an end to finger pointing and concentrate on what we need. If someone is doing wrong or has followed wrong ways, govt may/may not take care of them, it is upto the govt, why do we always blame fellow citizens or immigrants?
We all know, people immigrate doing manipulation, being illegal, over stay visas, jump fences, modify resumes, etc...... at some stage everyone of us would do some level of manipulation so why finger pointing?
Making our lives better and fixing retro is the goal why drag in consulting companies.

K , I see two views by two different types of folks.
View #1: This system sucks. Its not fair and just. America is a great country and land of immigrants and we chose to immigrate here. Lets work on this issue so that I myself and folks such as myself now and going forward do not have this problem. I will do what ever it takes. I personally feel that regardless of the outcome, it gives immense self satisfaction to commit to meaningful cause. Others might not feel so, but all of us believe that this problem needs to be solved and do what ever we can do.

Now My question is what do you want to accomplish on IV if you do not want to work on the issue, If you do not want believe in the core principles of this organization. If you think that immigrants are treated like dirt and again if you believe in that and because you are an immigrant in this country, you should have been putting up with a treatment like dirt, do you have an iota of self esteem?? Should I say that all of you those who bought homes and are having a life bought a home with 0% down and interest only loan so that you can save your taxes now and if your GC does not come through in 5 years, you will walk out with out any loss as you made hefty deductions and haven't paid single penny towards the mortgage and simply go to Timbuktu or Krakovia. I will not!. Just because you chose to buy a home and have a life does not mean that others dont. Every one lives their own lives. Those who dont buy a home live a life of their choice. Stop judging people. GC was not a risk or hindrance to you in buying a home but could be for Joe the Analyst. You might have deep pockets, Joe the analyst might not or have other commitments. Coupled with the lack of GC, his risk might be more than some one else.

Lets add more stories. As someone already suggested lets concentrate on how our GC can contribute to the economy - buying a house/establishing a company/etc. I also quoted some of the recent studies that showed how immigrant entrepreneurs positively contributed to the economy (couple links from IV).

Read the John Miano's testimony in Congress in July 2006. Do a google search and see.
There are people like him who have dedicated serious time and effort in exposing the misuse of H1B by a few bad apples and then use them to paint the entire H1B program as evil and unneccesary.
And no, we are not responsible for this.
The companies that exploit and the DOL that looks the other way when this happens, and the AILA that goes in lockstep with exploiting employers are responsible.

You should not have gotton H1B visa in the first place, as H1b visas are for professionals and there are many professionals stuggle to get an h1b visas even after engineering degrees. In your case, IGNOU is a shame. Its worse than University of Pheonix. If you get a greencard in EB2, it will be a biggest mockery of the USCIS and department of labor.
If you believe IGNOU or Univ of Pheonix are fraudulent, Please provide proof of this and also report to USCIS.
Its not purely education that will get you H1 or GC. You also need to be skilled in your field.
You might look down on certain universities or degrees but in the end employers care more about skill and experience and so does USCIS

A lot was said above but some basic things still need clarification.
I do believe that I HAVE THE RIGHT to get my LCA adjudicated in 2-3 months time (OK, make it 6 months, having in mind you are dealing with an inefficient administration).
I do believe that I HAVE THE RIGHT to know in short term (2-3 months, not 3-4 years !) if I am eligible for permanent residency.
I do believe that I HAVE THE RIGHT to know how long (if approved) will take the I-485 process.
These are clear, simple questions that require clear, simple answers. Getting these answers (NO is also an answer) in a reasonable period of time is a right, not a privilege...

Forum Gurus - I got a denial letter on my 485. I am a July 2007 filer and applied for AOS in July 2007. My 140 was revoked by ex employer in August 2008 and immediately I got a NOID from USCIS and responded to it in a timely manner and my case processing resumed.
But now, I got a denial stating that my 140 has been revoked in August 2008 and thats why my 485 is denied. My Attorney is filing for MTR and says it is a mistake on their side and will be resolved through MTR.
It just baffles me that the person who sent the denial letter never looked into the system to see my case trail and blindly issued the denial notice. My Attorney says, it is very much possible that they do not look at RFEs or responses - they just issue denials when they browse through the 140s.
I am EB2 India with a priority date of March 2006. I think some kind of pre assessment is going on. There are no LUDs and mine is at the TSC.
Is there anyone else in the same boat? How long does it take for MTR to get processed?

I think the best way to approach this thing is to increase visibility of the "American competitiveness challenged" idea. Which is basically - globalization has made it easier for foreign students and high skilled professionals to go to other places, besides the US. This is a long term problem for American competitiveness and immigration laws must be adjusted to solve this� (you see where I am going with this).
Recently a group of influential CEOs pressed lawmakers and the Bush administration on the idea and subsequently several studies/ reports were released (I have attached one such report). Let�s build our case and momentum on this for next year (let�s face it: immigration reforms are dead for the year). I think the IV leadership has a huge opportunity in guiding/ co-ordinating such an effort.
