mrajatish, Thanks for taking the initiative, we have thought about such a drive in the past but later on gave up because the transaction fees on 25 dollars comes to about $4-$5, which is almost same for $50. But yes if people can just spare $25 than even $20 which comes to IV is good enough to reach the target.
How about this - let us have a couple of volunteers call/email people asking for $25 contribution. If we can get 1/2 of 3000 people contributing $25 each, we will get to about 120K. I am ready to take initiative in this - core group, can I get this initiative going?

Does all this mean that if you have an approved LC it will only remain valid for 45 days?!
I am waiting to file my I-140 until my PD gets closer because I don't want to risk my daughter aging out.

No, 45 days condition is not for "to file 140 within 45 days of labor approval"
But it is for the company to substitute the LC for some other employee within 45 days.
There is no time limit set to file I-140 for the employee for whom the LC was issued.
I am waiting to file my I-140 until my PD gets closer because I don't want to risk my daughter aging out.

Why is the above important? Because it's a window into their mindset. But VB disaster was one issue where there was not even the slightest doubt that what had happened was horribly wrong and cruel that even some cold-hearted anti-immigrants were confused for a day or two and didn't know what to say because they didn't want to pile on our heartache. The way CIS works had, like any bureacracy over time become a cold and heartless beast but since they deal mostly with non-citizens who have little rights and feel so unsecure and unwelcome in the first place to ever speak out, they were never going to know how their actions are wreaking havoc on their customers lives. So unless affected people come together and act they are never going to know how bad it sucks to be on this end of the divide. And ofcourse it's not all CIS - they are just an arm of the government carrying out the law. it's going to be next to impossible to do anything without congress stepping in. And while Fragomen is definitely not lying when they say they will work for some relief and probably are given that their partners often show up on congressional hearings, they won't lose sleep over it nor will their passion levels be anywhere near that of those who are directly at the receiving end of this current ugly messi.e iv and it's browsers. That's why it's critical that iv be heard - & not just through flower campaigns. ofcourse bringing together immigrants was always going to be like herding cats but it shouldn't be this hard. give money people!

If you didnt have money in ur pocket.. why the heck did you go for PHd.. now stop complaining about people who got a job and started working.. why dont you tell the truth to everyone that you didnt get a job after you completed MS and ultimately to keep yourself in US you opted for Phd.

seekerofpeace - I hope they have not lost my file. I have not been able to get a concrete answer so far as to what is happening with my file.
My attorney had filed 140s for in EB2/EB3 and I hope they have not taken my app and classified it as EB3. We sent the EB2 I-140 with the AOS app so I dont think that would happen but stranger things have happened with USCIS.
Response that I got from the local senator and from what I read in the other thread you created, I think visa numbers are over for 2009 fiscal year. We will now have to wait until October. I dont mind waiting until October, but I want to use the next 15 days doing whatever I can, so atleast in October, I have some chance of getting approved.
Good luck to you, hope everyone who is waiting gets the good news soon.

Here is what I have understood from my lawyers -
DOL decree, if adopted, will prevent any further labor substitution.
Any labor approved after the decree is adopted cannot be used for substitution.
Any 140 application based on labor sub will not be denied until USCIS adopts a similar resolution - it is unlikely that USCIS will do such a thing as it will lead to lawsuits from lawyers and folks already in the queue
People with already approved 140 do not need to worry at all.
I am laying down the facts here such that people can make educated decisions on what they want to do.

well, I have to keep my hopes up. Since I HAVE to wait to get H4 extension before I can apply for H1 transfer, I'd like to see them last long enough so that I can get an H1 IN time, this year.
It can be so disappointing to get the job but miss the quota for 2 consecutive years :mad: :mad: :mad: and then 2 years I was ineligible for H1 because of the 6 yr limit. :( :mad:
Anyway, every dog has its day and I am hoping this is the year when I get my H1. :D

Think before you type. The core team mentions $$ and ground work. Most are not interested in doing anything besides reading these forums. Realize the enormity of the task, the efforts required, then look in the mirror and ask yourself what you did besides BS'ing

Organizations who have Millions of dollar In budget for pushing and lobbying their Issues failed also for whatever reason ( He did not mention reasons ).
Does that mean that having a fat budget does not Impact the outcome ?
What It proves Is Its really the Politics, election, People's focus on the Issue which matters and NOT the lobbying with big fat budget.
And If its the case then our issue will be taken care of on its own merit when all above factors are in our favour, regardless of lobbying.

Adding to that there is an independent case already filed in the US courts, so we are on a stronger wicket.
Again, USCIS cannot keep our application in cold storage without extending us the benefits of pending I-485 application.
We will get the good news soon.

In ac21 law; it doesn't say anything about the scenario if 140 is revoked by employer. It is totally silent to it.
AFAIK:
AC21 is not a law, just a guidance. Assume an immigration case goes to court hearing, the judge would completely ignore AC21 guidelines. Any employment per AC21 will be considered unlawful in this case. The probability of a case going to court is not very common though.
