As you know cap reached on 30thApril for Masters, can we assume applications that reached on Sat and Sunday(28th,29th)non working(non business) days are safe? or will the be considered to be reached on Monday and hence come under lottory?

first: my use of an extreme example to explain the EB category difference seems to have caused misunderstanding and offence among some people. this was not the intention, no slight was intended to anyone. sometimes one uses an extreme situation to make a point (3 yr degree in this case). I was not trying to stereotype and if that is how it came through...here is my humble apology.
i did reply to some of the posters by pm and had some intresting comments/discussion. its one of the nice things about this forum that people bring different insights into a problem...
qvadis, there is fundamental difference between allotting Employment based Gc on the basis of country of birth and based on job classifications/requirements. One happens to pertain to employment, the other is simply a way to mantain ahem "purity".
having said that, i do not favor the removal of country quotas in isolation- the redistribution of dates would make things better for long suffering people but it would not change the overall picture. therefore i support the package in its entirity (as does IV), ie recapture + STEM exemption + removal of country quotas. this would bring in substantially increased numbers and resolve the problem with ROW dates.
now that its established that this thread will not go back to its original intent, do the OPs mind if i close it? may be best to restart the discussion in a new thread?

This is a guess and I have not studied the law book or statutes on immigration law. Per country limit could be an administrative procedure and not as such a mandate by congress. The intent, nuance or spirit of the congress may not match this per country logic being implemented currently. There is just so much mismatch between equality, justness, fairness and nondiscrimination versus imposing per country quota and retrogression. It never made any sense to me. However, every quarter unused visa gets distributed irrespective of country limit. This nullifies the negative effect of per country limit considerably.
Everybody (that includes H1bs) in this country (according to Murthyji and other experts) is entitled to peaceful assembly, seeking justice and participating in improving current system!!
It is the beauty of the system here that sooner or later, people appreciate others point of view and there are enough checks and balances. Judiciary is one such important institution.

Most of todays GC process results in indentured servitude which is against the law. Just that the indentured servitude is implicit instead of explicit but its still there. Can we use this point along with these stories.
Well, if we feel that the GC process results in "Indentured servitude� may be we should head back to a land where we are treated like first class citizens and not complain about work ethics here. We are here because WE WANT TO BE HERE so may be this is the name of the game.

Students,
Please make sure your EAD doesnt start before October 2008. That way, you will have 2 complete chances of getting H1 if things wont change even after presidential elections.
General Rule of thumb is "Graduate in august put start date as October 1st for your OPT"
This is not easy coz when we graduated in 2000-2001 area we didnt had to choose some date just bcoz the visa ia not available. We used to worry more about getting a good job than this visa and we used graduate when coursework & thesis are complete. I think things have changed drastically.

For name change in US, you must go to the local county court and get a name change court order. That doc would contain the new name, and should be enough for updating name on any US documents such as SS, DMV, etc.

but the categories and priorities were created to be based on the jobs too. and there are people in EB3 with bachelors degrees only. so what? it's meant for jobs that need a bachelors degree. it is indeed your misfortune to be in EB3.
It's very interesting to see the fight between EB2 and EB3. You don't seem to be concerned too much that EB3 is in a disadvantage. Well, the original topic was the 'disadvantage' of oversubscribed v. other countries. What if we apply the same principal of equality of EB2 and EB3 applicants and remove these categories completely. That would mean that EB2-I wouldn't get any GCs for the next two or three years until EB3-I has caught up. Fair?
I don't want to get into the discussion if country ceilings are fair or not. If, however, it was suddenly removed, ROW filers who are only a few months away wouldn't get any GCs for the next few years. I haven't seen any opposing comment, suggesting that the meaning of the I in IV has changed.
Anyway, in my opinion, the best bet would be to try to recapture Visas and increase country ceilings or set a portion aside for heavily retrogressed countries.

Anybody else want to take the same challenge as mine, if we achieve the 60000$ target by Dec 31? 20$/month contribution is not BIG at all.
Starting Jan 2007, I will chip in 20$ per month every month until we get the bill for GC relief cleared, if we can beat Anurakt's challenge of 60000$ by 31st december.

It was inspiring to see some of the returning folks from 2007 and also to see a lot of new IVians/ IVers. Hats off to you all for your service to this good cause. May god bless America and may god bless you all.
We have come a long way since Aman a few other brave folks came together to form this group in 2005. Only in America can a truly grassroots organization unite diverse people from different countries, backgrounds, genders and race allowing them to feel empowered and showcase their issues and problems to the venerable American institutions like the Congress and the Senate. Unfortunately, issues faced by the High skilled legal immigrants have been a low priority. As future Americans, only thing we can do is make them aware about our issues. Hopefully, the lawmakers will act, sooner than later, in American interest to salvage the sinking oil well of legal immigration system.
A few brave souls whispered about the current financial crisis before it arrived at the American shores but we all ignored those pleas and warnings. Here we are again. This time the stakes are higher, it is not just about our green cards but it is about American competitiveness and American values. Will the next generation of Americans be able to look each other in the eye and boldly say, yes, we can do the right thing. Our principles were tested but we did the right thing. It took time but we did the right thing.
As legal high skilled immigrants we can do so much. Provide facts to counter opinions. Organize advocacy events to counter demagoguery. Hopefully, all this will become sweet nostalgia where we all reminisce about the long hardships we braved and in the end the American dream did turn into a reality instead of a nightmare like the BP oil spill.
I just heard that a friend moved to Canada, Toronto. He had a baby last year. I was excited for him then. Now, I feel sad, not because I lost a close-by friend here in America but because he always did the right thing. Always followed the rule of law worked hard but in exchange he left empty handed from this great country where he had come to make his fortune and contribute in many ways through his talents to this land. All because of the currently broken legal immigration system.
Economic scenarios are changing. Top talent is becoming a scare commodity. Laws of demand and supply will eventually win. Resource and talent hungry countries are starting to compete among themselves to attract and retain the best and the brightest. The canary in the coal mine is singing softly but hopefully the miners are listening.

what makes you think that EB3 are just graduates only? i worked in top 3 telecom company with B.tech+ 8 years experience before joining that company as full time employee in 2000 Jan. they started by GC process in JAn 2001.
but they have a company policy that all will be filed as EB3 no matter what. i have my colleagues who have masters from US, but still EB3. what do you say ?
what pisses me off is today i have more than 15 years of experience in IT , (yes Information technology only) and still in the line with EB3.
I'm happy that atleast EB2 is moving but at the same time there must be a balance for EB3 as well. that's all my point
(NOte: i was playing by rule so far and no regrets for that)
because they spent those 2 years getting additional academic qualifications such as masters etc., you should have listened to your parents when they told you to study well.. didnt you play cricket then ?
