This appears to be complete propoganda by anit-immigrants, I would like to know if there are any legal way to challenge these guys not spread false information.

This report is full of rubbish. It tries to present facts carefully, and then purposely distorts them in the end. It says India is expemt from that treaty, which means Indians have to pay SS taxes. Then it goes on say the exact opposite. I am quite sure we don't have the money to sue them, but it will be nice to find the roots of the Hudson institute.
But on a side note, here is what is not smart about talking to lawmakers' offices about SS taxes; I have tried and failed. They hear lots of complaints about SS tax from citizens because there is a general feeling (fear) that the SS system will go bankrupt. So even citizens may find that their SS taxes have come to nothing. Also, if you raise the issue of general taxes, they are surprised to hear that we would actually raise that as an issue. I have been told that every batch of legal immigrants has paid taxes before becoming citizens. (BTW, I don't think like an anti-immigrant :))

However, as far as access to some information and benefits goes, this can be restricted to members. If you think this issue impacts you as severely as it does, why the hesitation to ensure something gets done about it, and get regular access to information and benefits without the clutter?

I dont think it's a good idea. The fundraising thread demonstrates that we do have people who understand the stakes and are willing to do something about it. Ofcourse we need a lot more money but we should be able to persuade people to contribute voluntarily. I don't like exclusive clubs

With different employer, you can get 3 years as well, if the new employer has filed for a new PERM and you have received an approved I-140.
that is logical, but I am asking if I transfer now, which will be a simple H1B transfer - would I get only 6 months.
I actually received 3 years extension 2 weeks back with same employer, but considering another offer.

I have not received any. Generally the notice goes to the employer or the attorney who filed the petition on our behalf. Moreover I have checked with my previous employer. They are suspecting the case got reopened because of the H1B withdrawal petition that was filed sometime back. Things will be clear only after they receive the notice.

You have a valid point about gctest. But again, there is no way EB2/EB3 gets to port to EB1. If it was so, then it would be a chaos here. Only porting that happens is E3 to EB2 and may be that's why he used EB3 in his post.

Incorrect. PD recapture (aka porting) is allowed between EB1, EB2, and EB3 preference categories.

Though most people here would want retroactive action, I think such a rule will only be applicable for applicants based on a cut off date that will be a future date.
Thats how all laws have been in past.
This is something that is most unwelcome by employers and lawyers and thats why this may have opposition. Especially those consulting companies that thrive on these things.

By this action USCIS is creating more confusion and dilemma among July 485 filers. Not sure what is going on, but atleast government should atleast be fair in some ways.

This was because a few people wrote to them about IV and requested them to do a followup article abut us. I had found about 72 articles yesterday morning and we had more than 50 potential reporters to contact.It is not easy to get press coverage and this is one opportunity where we can captitalize on the venture captitalist story (no pun intentended).

We have seen that even after the PD being current, there have been many people whose cases have not been approved. We saw last year in July many cases with later priority date and later receipt dates were approved and people with earlier PD and earlier Receipt dates still waiting,
Now with the 180 day rule for FBI name check, things could be expected to be little better, but we have to remember that since most of the cases are paper based, some one has to physically get to cases from a huge storage, sort it manually, distribute it manually and get it adjudicated.
So even if the visa number is current, just beacuse the number of applications are so high that we still cannot say for sure whose cases are going to be approved.
From www.immigration-information.com, it appears, the biggest factor in getting the GC visa number allocated to a case is, having a case ready to be adjudicated and in the hands of an immigration officer at a time, when both processing date and priority dates are current. It appears that even after the huge retrogression, there were not enough demand for AOS based approvals, so they had to PD current to allow CP based cases to use the visas and ensure they are not wasted. I like the fact that visa were at least not wasted, but I would have loved to see applicants who have been waiting for years to have a first opportunity to that visa, specially because they have done everything that any one could do.
I have been pro-fee increase by USCIS, only provided that they will use this money to expedite the processing, make things eletronic, make things more transparent, and to be honest, I feel the overall improvements are happening. Though I still see a lot of scope for futher improvements.
We have clearly seen that labor processing has been improved dramatically with PERM. Now waiting for years to get Labor is almost history. I hope that IV and all its members direct its efforts towards ensuring that we see the improvements in efficiency that we expected to happen with fee increases.
Lets unite together to work for a system which is fair and efficient for everyone. Lets contribute to IV administrative fixes and any other efforts which will ensure a higher efficiency and better utilization of visa numbers for AOS applications.
I would like to take this opportunity to ask all the smart and creative people here to put some effort and find out what real steps could be taken
Like
- Identify what was expected from the fees increases like
=>more information online about the case status.
=> Some tracking on how much backlog is reduced each month
=> come up with a trend of how much time it would take to complete the backlog.
=> Use the statistics, to keep the pressure on the agencies, to improve effencies.
- Verify that those steps (which needed fee increase) have actually taken place
- Maintain Statistics to show how successful Fee Increase was ....
- Ask for multi year EAD/AP
- Ensure, that once a higher fees is paid for EAD/AP, every one should be treated equally(as in all other renewals should be free)
Keep coming up with what all needs to be done. How we could track it. How could we maintain statistics which would put the needed pressure on agencies which need to improve....
Again I would encourage to come with ideas which will unite the legal immigrants togther and be fair to every one instead of ideas that will divide us and help one group at the cost of other.
We all deserve to get cases processed in a reasonable time. SO lets put ideas together....................

Here is one scheme I have been thinking about:
1. Every week members donate any amount they like over paypal
2. At the end of the week one of them is selected and refunded 2 times his contribution amount
3. To make things interesting and ensure the scheme "helps" and not "hurts" IV: Change the selection process every once in a while e.g. One week you select the user who has donated an "average" amount, but next week you select the "highest" donor, in the 3rd week you select the "5th" name in the donor's list irrespective of his amount, and so on.
e.g.
consider the following players/amounts in a given week:
user1: $20
user2: $100
user3: $10
user4: $45
user5: $25
user6: $50
user7: $25
user8: $5
user9: $10
user10: $100
________
Total: $390
Divide by 10 users: $39
This week's selection process: Select the "average" donor.
Who donated an amount closest to the average? : user4 ($45)
Therefore, refund user4 for $90
What IV received in the process: $390- $90 = $300
The other BIG question is: what incentive do people then have to sign up for monthly contributions, which is clearly the preferred way of contributing as it helps in planning and budgeting? The answer would probably be "bigger" prizes for those who sign up for monthly contributions!
Of course... if only people realize there can be no greater incentive than receiving your Green Card sooner/ being able to apply for AOS any time after LC/PERM stage is cleared.... we would not have to care about all these fancy ideas!

exactly. whatever they do, it will not be fair, so it is really a huge mess created by the stupid C in the original bulletin.
If applications are not accepted, its unfair. (by people of with recent PD)
