    Came to USA on H1B, paid for the H1B fees(at that time didn't know it was illegal to do so)
    however after coming here , Paid for my own ticket and landed here on start of january 2011.

    I am a little doubtful...if this was illegal.
    Since you had no knowledge at the time that it was illegal.
    Being a foreign national you may not be expected to know every law here.

    How much did you pay? was it more than what the fee was?
    Did the employer processes your visa or did they use the services of an attorney?
    if you...then you have a case to sue the employer for scamming you in civil court...as he may have used this trick to eat your money knowing fully well what would happen to you once you landed here.

    Talk to an attorney here before you leave.

    IMO, this is the biggest problem plaguing IV - perception of IV as just another online forum (community) or a "chat room" as a newspaper reporter put it ! (http://www.freep.com/apps/pbcs.dll/article?AID=/20071123/NEWS07/711230422/1009) (under the heading "Taking Action").

    This point IV = chat room has come to the fore, several times in discussions. A lot of persons have refused to join IV efforts with the ruse "IV is just an online forum where members discuss mundane matters". Whether someone admits it or not, IV has a serious image problem !. It needs to be corrected soon (by more than making another announcement type "We are not a forum" post !)

    Strength of an(y) organization comes from contributing, active members. And not from MINOWs (Members-In-Name-Only Wusses)

    Raj, Thanks for the reply. I am still looking out for the bride which is the reason it may take about a year or so.. So no chance of civil ceremony in a months time. 

    I have few more questions..

    1) What does it really mean by withdrawing the I-485 ? Does it mean you withdraw only the 485 application and can reapply (just 485) it later when you are ready (when its current) ? Or does it mean the full GC process is cancelled, which means you have to start with your labor again at later point of time?

    2) What are the real benefits of applying now for I-485 in my scenario? If I get married after the 485 is filed, it sounds like I am forced to anyway maintain my H1B till I get my spouse on H4. Also to apply for my spouse�s 485, my PD must be current at the time of filing. If not, then again I am forced to maintain my H1B till the dates become current.

    Just to summarize, it sounds like I have to anyway maintain my H1B till I apply for my spouse�s 485.
    So far, does it sound correct ? If not, please correct me..

    If the above is correct, why not I apply for 485 after I get married ? Is that a bad idea ? I know I could save about 6 months to an year (may be more in some cases) if I apply before the marriage, but then I am taking the risk of getting approved 485 before my marriage.

    Any thoughts?

    There are so many stages where you can apply the breaks. Like if you get your FP too soon..you can reschedule the date or even withdraw the I-485 application later. Other option is to convert to CP. There are so many options and talk to your attroney.

    I feel you should file now, try to do civil ceremony done in india in 30-45 days so you are safe.

    As I mentioned in one of my post not even 100 persons responded. It either means there is not much persons who are impacted by the memo or most are not interested. For many people to participate they will need to know the details and directions. But most update might be in donor forum. So I think in future IV will get good efforts from only donor members. But if enough donor members are there then that will be ok for IV to get success in any drive. Otherwise it will be tough as there will not be enough people for advocacy efforts

    But this drive might have added a few donor members. In that way it is good.

    I am in "Not in H1 and not affected" category but willing to contribute both time and money for this cause.

    Probably his employer is finding excuses not to file his GC and like his employees on H1B.

    Dude, whatever it is, get out of that hole if you cant get GC filed.

    1. Line up another job.
    2. Go there or else, tell your employer, that "Find a way to file my GC, otherwise HASTALA VISTA baybee...".
    3. Choose your option.

    I was in similar situation. My previous company was merged into a new company, and I got screwed big time on wage issues.
    Yeah, I learnt everything the hard way.

    But for people out there, if you have a choice, utilize it. Don't give into exploitation

    No I wouldn't. Get it from the your child's pediatrician since they know the case history and will be able to word it correctly. Remember that the letter from the pediatrician is the basis which the certified civil curgeon for USCIS will use to apply for a waiver if he/she thinks it is necessary.

    I checked with both pediatrician and Civil surgeon and they both are of the opinion that TST test would not impact a nursing mom.

    My attorney told me that my wife needs to get back before her scheduled trip. This would incur huge costs plus it would be difficult to get the seat arrangements. ( We have a twins and we have seats with bassinets for the infants). My father is also travelling with her.

    Is it possible to ask 1 month extension for RFE based on the difficulties. I'm EB3 IND PD 2003 and I dont think our I-485 is waiting for adjudication any time soon.

    I've scheduled an infopass appointment tomorrow. What are the chances of getting an extension when I present my case to IO?

    I'm worried and it makes us very anxious.

    I like majority of others who came here on H1 with genunine intent of settling down should work toward common goal of easier GC processing and not support outsourcing idiots esp L1s who is nothing but shipping jobs overseas and making a field (eg IT) minimum wage pay. Just look around how much TCS pay .

    COmmon goal of us is easier and humane green card processing and to work towards the goal to stop blatant abuses in the form of L1 (and some H1 )

    Guys,

    I feel privilieged that I have an opportunity to work with the same employer as Aman. I remember talking to him one year back, when he first mentioned retrogression. Like many others, I was naive and thought I dont have to worry about it until 3 or 4 yrs. I have seen him in action, he is the most polite human I have ever came across, who is super soft in his heart but super agressive in his actions. I know that he sold his house to generate 64K to spend for IV.

    He once told me that he likes to socialize with fellow employers, indulge in office politics, etc and be a typical employee, but unfortunately he cannot because he would rather spend that time on IV and build things for IV.

    I know for a fact that, his boss is not all too happy about he dedicating his time to other efforts. But he stands like a pillar to protect our IV community.

    In a nutshell: Here is a man who is willing to give whatever it takes to stand up for what he believe in. We the community should be extremely happy to have people like him and Logiclife.

    I will start my $20 dollar contributions / per month recurring contributions today.

    In my opinion you are doing the right thing by reporting against your employer to DOL. DOL take their own time. But I have known a case where the employer had to shut-shop coz of complaints from former employees.

    As some others have mentioned, look out for transfers with consular processing and get back here.

    Good luck with everthing.

    Yes...its true if the employer is at fault. Means, after inviting you here and does not pay on bench.

    But here, it seems the OP has come here after getting the visa stamp without his employer's invitation and didnt report to job. I already have heard from attorney on a smilar case and also seems like the employer can easily defend himself.

    At worst it will have black mark on the employer and nothing more than that.

    EAD & AP is luxury & aggressive. Keeping H1B active is being conservative and playing with probability and backup. It depends on your nature. Go for it!!

    If you are planning on a big investment like buying a home or something like that. It is better to stay on H1B so you have a backup if something goes wrong with GC.

    I have seen problems with cases using AC21 when they apply it asking for more details and also sometimes ur I-140 is revoked by your sponsoring employer and USCIS may trigger a NOID for you. Ofcoourse you can file MTR and prove that them that it is legitimate to change jobs using AC21, but if you have H1B also then you have a piece of mind.

    Also for the first job change use AC21 and do H1B transfer also and see for 6 months so that USCIS is already aware that you ve changed company. You can address any RFE/NOID. But later on you are on ur own.


    Okay I like the reply.
    Big investments like house is another point to consider. Right. It is not easy to sell off your house and leave in case AOS is rejected.

    I know it goes without saying that it is individual's choice whether to keep H1 or EAD/AP. As I said I want to know what Keeping H1 brings to the table.

    Imagine if Uncle Sam held an auction to allow you to submit I485 EAD AP, what would you have bid for the right to submit?

    Maybe $640, $6,400, or even $64,000?

    If Uncle Sam charged a fee to submit now rather than waiting for another year or two or three... What would you have paid to submit I485 and get EAD AP AC21?

    Alternatively, how much are you going to benefit from EAD AP or AC21?

    AC21 -- maybe ability to move jobs and get a few thousand $ pay rise?
    AC21 -- maybe not going to the back of the queue -- really worth thousands!
    EAD for you and spouse -- maybe a week of salary for someone that could not previously work?
    AP -- how much is it worth not to have to waste time and money renewing H1B at an embassy. That's at least a few days of time you don't have to waste (and time is money).

    How much will you save from filing under the old fee structure? At least a few hundreds.

    Now use that as a guideline for what you are going to contribute to IV.


    There are still problems ahead for most....
    * retrogression
    * BECs for unluck some
    * name checks (I personally know someone that it took almost 2 years for).

    IV is now the most credible organization there to help get these issues addressed. So let's hand over the $.

    I wish more people shared this thought and even better did this rather than just say to vent. And the GC line would have been smaller.

    Lets not waste time blaming others rather work on upligting yourself and if you think you are capable help others too. If this was your once-in-month harmone reaction, please pardon my preachings. But than this is the only country where you can attain goals and dreams that are un-imaginable anywhere else. So if you have been categorized in EB3 think about how to migrate to EB2 and same for EB2 to EB1 or into some other category ( family etc.) that can help you attain your goal ( assuming GC is the goal at this forum, presently).

    And I like to remind myself, if you comment on others be ready to be sermoned. Hope you all will be kind. Peace be with you.:)

    "...Demand" and "right" will work up to the point in which we don't irate Americans. America has been sympathetic to immigrants in good part thanks to the capacity that America has to accomodate us here. If an excessive number of immigrants get in and that alarm citizens, I can tell you this country will become as unsympathetic to immigrants as many European countries are.

    ....Just be careful with the idea of "demanding" and "rights" though :)

    I agree that it is very important to clear what is "rihgt", "privilege" and "symphaty". I tried to do that several times before and in order to avoid any misunderstanding have quoted below a part of one of my messages. Please read it carefully.

    "I do believe that I HAVE THE RIGHT to get my LCA adjudicated in 2-3 months time (OK, make it 6 months, having in mind you are dealing with an inefficient administration).
    I do believe that I HAVE THE RIGHT to know in short term (2-3 months, not 3-4 years !) if I am eligible for permanent residency.
    I do believe that I HAVE THE RIGHT to know how long (if approved) will take the I-485 process.

    These are clear, simple questions that require clear, simple answers. Getting these answers (NO is also an answer) in a reasonable period of time is a right, not a privilege..."

    Americans have the right to determine how many immigrants they need and how to handle this issue. But we have the right to follow clear and simple rules for that process. It seems to me that the way they currently handle the H1 immigrants has a lot to do with the "Las Vegas" type of business (gambling) - shall I get my LC approved, when will I get the LC approved, shall I get a GC, when can I get the GC etc. The rules change permanently and half a million hard working people are in limbo for a decade and more. That is not fair and this is what you have to explain to the Americans.

    And, btw, if the local IT "professionals" you were debating with were so great, they would not be unemployed...
