Do you think it might be a good idea to ask people to pledge amount that they don't know how much is going to be ?
I think instead we need to do the following.
1. Clearly state in the very first message the need for creating this thread (pls include the business week article, Pappu's comments, comment from Aman's co worker - If you need help finding it, i can do it for you).
2. Also add to it that this is for the reimbursement of the expenses of the past. We don't really want to concentrate on how this is going to be handled in the future , may be someone can come up with suggestions on what should be set aside as administrative funds and things related to that. This is only for settling the amount already spent.
3. Only pledge is required stating the amount clearly and no funding is required at this time. We will instruct all the members who pledged once we get an expert advice on how to channel these funds.

I am thankful to everyone who read or responded even if you don't agree. Taking it a step furthur there are couple of things that stand out which i think again show how we twist every fact to our advantage.
1) US need immigration to grow and prosper. wel agreed, but who are we to preach. Its for American to figure it out. We don't care for our mother land i:e India but we are first to point out how US will be worse off if it stops immigration. I really doubt the intention here. You know, we care more bout US then India and once we get our GC we probably wont care much bout US either.
2) Saying its a fight for rights and if we don't fight we are cowards. well i agree we are all cowards not because we are not fighting to bring forward all mighty priority dates but because we showed our backs to our own country. We went to public funded IIT and other institutions and then ran away from our nation at first chance. So yes, in a way we are all cowards here.

I read the text again, and found that text is under 'Sub Title A - H1B Application Requirement', does that mean the new application has to meet the requirement but existing H1B holders are allowed to work until the end of their I-94 date? It would create a turmoil to stop all H1B contractor all in a sudden.

The big consulting companies including the outsourcing companies thought that the demise of staffing/consulting companies would land them more business and the displaced H1Bs, not realizing it was just the first step of the Antis in their direction as well. Well now, everybody has been given the jolt of electricity.
Sadly it should not have come to this point. Had it been the year like 1999 with all the efforts from IV, I am defintely sure the CIR reforms would have passed by now.
Issue here is the economy, recession looming large on our face, unemployment level rising, and no one knows whats going to happen in the next two-three years becuase of credit crisis and oil price going above the roof. If this continues for another year, we will be in deep s***.
Thats why no will dare to increase the workforce by issuing more grren cards. Atleast we should feel happy that they havent stopped issuing the cards.
I know its painful to be waiting for years to get a GC. But you do not know how green that card will stay if the current financial crisis continues for 2-3 years.
Fact is, this country is going thru a difficult period of uncertainty. Because of election year rhetoric, no one is going to accept it. But clearly, its not in their interest to get more workforce into this country. They know we have been waiting, and will continue to wait. Look at 2002/2003/2004, when they issued only 20K visas for the entire year. So just hope that things will get bright for this country soon else, we are in for an another hell ride.

When you call the law makers and tell them you support XYZ bill.. my question is what do you get out of it!
When the lawmaker realizes that he is getting 10000 calls from LEGAL aliens,
>who are not from his constituency,

what is the motivation for the law maker to support the bill�
So to avoid sounding stupid and foolish and desperate when you call� a more logical approach would be to :
a) Generate a public petition form on IV website and have all the members� login and sign the forms digitally�
b) Then have IV reps.. fax them and send them to lobby groups �.
c) Lawmakers will listen to one talking head�and not worry abt 1000 calls that borders on ..�saar �support the bill saar�..
How many of you have actually talked to the lawmakers? Its always the assistant!
But instead .. someone says we have a signed petition of 25000 members effected by immigration mess �. And it�s a hi tech workers lobby group ..every lawmaker will talk to you and not the assistant!
Conclusion: calling the lawmakers haphazardly is actually hurting IV cause..to a certain extent!

This is truly unfair where country of birth determined who gets an 'Employment' based greencard before someone else. It can only be fixed by eliminating per-country limits.

I am already financially/emotionally drained out due to my accident. I guess its going to be deja-vu for me again.
Now I have hardly any money in my bank accounts(around 14K to be precise), and no house , which seems to be a good news and they cannot rip off much.
Only questions I have now are:
1. Any idea generally how long these things can go on?
2. During the trial will there be any restrictions on leaving the country (In genuine emergency situations)?
3. In the worst case if I am willing to give-up my GC..would it still make sense for us(my spouse and 2 kids) to go thru all this emotional stress all over again by staying here and thinkign about what will happen tomorrow...?
If you have only 14k then that is all that they can claim from you. In extreme cases they can consider put a lien against your future pay (for eg: 50% of future pay going to pay for the damages).
But don't worry so much!!! Why you will ask? here are the reasons.
Firstly, it matter who is suing you. Are the lawyers representing the insurance companies of the victims or are the lawyer retained by the victims directly.
If the lawyers are retained by the victims directly, the victim has to pay the lawyer to fight this case. The lawyer will only fight if there is way they can get you to pay the fees. The fees for such a lawsuit will far exceed 14K!!! So what you might want to do is request a lawyer to write a letter on your behalf to the lawyers of the victims and request them to settle out of court. for may 10K or else threaten that you will leave the country and they will recieve nothing!!. Ofcourse you don't have to leave the country you are using this as a barganing chip. Move the 14k to india in your parents or sibling's name. that way when they do an asset check nothing shows up.
From your posts you are sounding very stressed!! don't be relax you don't have to give up your GC. You have get a lawyer to help you out and pre-empt this before it goes to trial. Even after it goes to trial get a lawyer and fight for this (provided it does not cost you more than 14K). If you or your wife or kids are in university, most universities have laywers who will give free advice to students. You can also choose to pay between $100-$500 for consulation with other lawyers (remember the lawyers you are going to consult also want to make money so they will push you to retain them and some of them will scare you with the most unlikely scenarios. Filter this out by talking to 4-5 different lawyers).
G'luck. this is not the end of the world and frivilous lawsuits in the US are more common than legitimate lawsuits. This is not worth your sleep! Fight for this and don't think about giving up your GC for this!

I think WD already posted the action items - questioning the radio shows fairness and if they feel they have a responsibility in not inciting hate crimes toward immigrants both of which are very good points to raise. Lou Dobbs already has a huge platform from which he is spewing venom on immigrants and the last thing he needs is another medium - radio - to carry it even more.
GC is a pre-req to becoming a citizen and once you become one it is hoped that you would voice your opposition even more against hate-mongers like Lou. What he is indulging in is despicable - using the average American's economic insecurity and playing it off againts immigrants - & one does need to speak out if not for yourself atleast for others that can't do it themselves so WD is doing the right thing urging people to call in.

I have a few Questions for you I would appreciate if you can please answer them :
1. When you Applied for H1B Transfer in Permium Processing, which I-94 #
did you gave to USCIS.
2. What did u or Attroney answered for Last Manner of Entry Question
3. Are you within the 6 Years limit for H1B or beyond i.e. using I-140 Approval.
4. Did u get any RFE for your H1B after using AP.
Please let me know.

In my case, I travelled back on AP as my visa extension stamping went pending in Mumbai consulate. Came back here with my I-94 indicating "Parolee" as my new status.
Within 2 weeks, I changed employer as per AC21, they filed for my H1 transfer(premium processing) via Murthy Law Firm. I received a new I94 which put me back in the H1B status. During this 2-3 weeks I was in the US as a parolee I did NOT use the EAD, because you don't have to.
Interestingly after 3 months of my visa application at Mumbai consulate (2 months after I reached US) I received an email from them asking me to submit my passport for stamping. Its unbelievable that they think applicants would still be waiting in India for 3 months and that their employers would still be interested in keeping them, but I guess after all this ordeal I realised, they just don't care.

I have had v.bad experience with them ..don't open a account there ..they will harass you like anything to send this documents and that ..for me they did the same and kept my money for 9 months without paying any interest. I will post the email that I had recd from them . they even misplaced the draft which had my principal
I took visitors health insurance from ICICI Lombard.
There was some typo in the date of birth ( my mistake actually)..so I wanted to correct it..The callcenter ppl told me that once policy is issued you cannot make any changes to it..they advised me to cancel the policy online and buy another one..they will return the money for cancelled one.
So I cancelled the policy and took another one.
They sent the cheque to my parents house after couple of weeks for the cancelled policy and they deposited it to ICICI Bank account.
Now the fun starts..the money never came into my account.
For the next 8 months, I was BBQ'd, did a sheek-kebab of myself without any use.
Finally, I got every email ID that ends with @icicibank.com and whereever there is @icicixxx.com and sent out an email blasting everyone..then also sent an email to icici bank manager from my online service manager.
Finally I got a response saying they deposited the amount already 8 months ago..I was so pissed off..I took a screen shot (.bmp) of my account for that period asking them why cant I see the transaction here..
then after a week, they emailed me saying, the amount was deposited to wrong account..means someone elses account..LOL..

Nothing ever is super-fast. Certainly not the green card. You had your share of waiting. Its just that you suddenly see light at the end of tunnel and before you realize you are out of it. So it feels like a dream.
There have been folks who have got their greens in two years flat. Not because they were the smartest workers around. That is lightening fast.

you have a PD only if you are in a pool that has a restriction on the number of GCs that can be issued in one year. if you are exempt, basically you don't have a PD. That is, it is always current. You do wait for them to finish processing your I-485 for which there will always be a processing date, which may or may not be current for you.
Also, please don't give any such ideas to USCIS; they may like this particular idea :D
I interpret SKILL as follows for US MS.
1. You wait for your PD to become current.
2. When your PD becomes current, you are not counted against the cap.
