Friends,
What I need to do now? My I-94 has wrong expiration date (I entered in US on 03/07/2007 and I got I-94 with expiration date as 01/10/2007). My attorney told me that it can be explained later. So, I've already file my 485 with a bad I-94.
Please let me know if anything can be done or still I can do something to correct this issue.

I don't see anything positive in the Visa Movement....
It will be good only for July 1st/2nd filers because I-485 receipt date holds priority over the actual Labor App priority date and for those with receipt dates of 485 in Aug or Sept I don't see any hope of clearance since there are millions in line ahead of them who are the July 2 filers. Same happened to ppl with Labor PD of 2006 but had a July 2 485 receipt date and were able to jump the line.
Also USCIS is not going to adjudicate any cases without throwing an RFE since more than 2 years have passed and by the time people respond to the RFE the October bulletin will be effective and it will be another huge retrogression as history has shown.
Pity ...for the sheer mess and for the so many legals waiting forever...

Now I think some major clarifications are needed here. The Receipt Date (RD) that is printed on the I-485 receipt is the date whenever queuing according to RD is needed. This is THE date wherever a FIFO is required and is as assigned as soon as the envelope containing the I-485 is received.
The ND only represents the date data-entry is made. This is the date which is mentioned erroneously as "received date" on the USCIS online system. Now this thing has been mentioned at USCIS liaison meetings by center directors and thro' AILA several times (I will post the reference as soon as I find it).
That said whenever I talked to NSC officers (not the National Customer SC non-officers or regional call center IIO's or Infopass ignoramuses) ..officers who personally were aware of the going on's at the service center they said the Notice date does not carry any value for case adjudication priorities and the CLAIMS 3 systems only sequences (or sweeps as they call it) as per the PD and RD (when needed).
Further, since I see all the notes made for my approved I-485 (thro' FOIA) including the worksheet completed by contractors. I clearly do not see any notations mentioned with reference to the ND on it...
That said, for the OP, since your RD is very close to the "official" processing date there are all chances that your application might have already gone under the eyes of a CAO (Center Adjudication Officer). Call NSC directly and ask since you are so close and especially since your date is going current next month....you want to make sure that your file is either pre-adjudicated OR assigned to an officer.
If your "real" receive date (what you see online as "your case was received on...") is within the published processing dates for your service center, and your case is straight forward, most likely it is preadjudicated. In that case, as their SOP says, they put them in PD order in waiting for the visa. See the SOP below (which is a bit out of date). You are pretty high in PD seniority. you should get a good news soon. Best of luck.

pappu, pls let me know, if u received the fund. Also, one small suggestion, we can just maintain a small excel sheet, to just see who (just the user id and not the actual name) contributed and how much money they contributed just in this campaign. Cos, I hate to say this, I just dont want to be around those who want to have a free ride from all the hard work that IV group is putting in. Please everyone please donate. If you are reading this post, if you have not contributed earlier, please contribute. Dont you want IV to become strong financially when fighting this tough case. They need all the help they can get. First of all hiring someone on tourist visa was illegal, You had not thought about the safety of your child while doing it and without proper background check or reference checks hiring someone for nanny or anything like that involving children can be risky. There are instances of abuse which certainly will go un noticed.
From a legal perspective, Did u have a written contract for nanny, even if you sue the person you might not be able to recover anything and hiring an illegal may land you in trouble.

How can you think of USCIS going back to something that doesnt exist any more (Fraud is diff story) , Admin Fix is for something that is existing, and in hands of USCIS. per law ppl ported dates and it is valid at that time.. Per law ppl can still port dates from EB3 to EB2 or earlier dates in the same category. Admin Fix cant back date the LAW. Simple common sense. You can keep clogging ... Instead we can work on the same energy for Recap.

The quick way out of this mess is to ask CIS to move subst labor folks back in the queue. That will ensure that both EB3-I and EB2-I will move forward to July 07. Most of the labor substitution took place in that month itself.
This is an admin fix and does not require any new legislature. This is an idea whose time has come.

Received receipt notice on 30/04/2007 which mentioned RFE mailed on 30/04/2007, however till date the lawyers have received nothing, does it take that long for the RFE to reach the lawyers??? its already been 13 days...Please respond...

The idea that core wants to float is to have an effective campaign under the IV umbrella. Please come up with more innovative ideas and discuss with core.
I think this campaign can be pretty effective if we want it to. This idea is not totally outlandish. If you recall, recently fans of the CBS series Jericho sent nuts to the office of CBS when that series was discontinued.
Sometime back, Indians in the UK sent thousands of unstamped letters to their postal department, protesting a stamp that hurt their religious sentiments.
Those campaigns worked and so can this. All we need is a little bit of enthusiasm!

I wrote a letter to the university chancellor where I graduated from and urged him to use his power to influence lawmakers to pass STEM -or similar -bills or face the consequences in the form of dwindling enrollment of brilliant students. I used strong but not so harsh words. Refer to the following thread.

My state chapter leader was also excited about this idea. I posted the letter and the chancellor's response on this forum only to motivate someone 'higher up' to read it, endorse it and make it an action item for everybody (with a US degree). I feel now that I did my part as a dedicated member but the IV leaders (those who have the authority in IV circle) failed to lead my initiative or take it to a higher level (may be I am not able to find better words here).
Usually discussions get buried in forums. People open all sorts of threads and discuss - which is fine, but when some real effort is going on - I recommend the person who is behind it to own the effort. Thats what IV is - everyone MUST own the effort from start to finish and not give up or pass it on.
It is difficult for people to spend the time and effort in a thankless job. And we all need a lot of motivation and courage to do things. We are all professionals and currently dealing with politics and bureaucracy - must understand how difficult it is.
Below is for all readers
I just read the messages from Aman and Pappu - their tone is understandable - they are definitely stressed because they have to deal with all this. Am sure they are definitely looking for committed individuals who can help them and who can be trusted. There must be more than 100% commitment to do what they are doing.
Is it possible for everyone to commit themselves at that level?
If not can people do the following at the least?
(1) Provide correct information
(2) Contribute monetarily
(3) Join State chapter
(4) balance their schedules and create some time for IV and do at least something
(5) Stop crap talk and blame games and concentrate only on useful stuff
(6) Contribute in any other way - publicity, convincing friends, coming up with innovative ideas .....
(7) Channelize all your frustration into positive energy.
Based on commitment, availability, skill, trust IV can definitely utilize your help in different levels, maybe ann admin, maybe a chapter lleader, maybe a chapter member , maybe a media coordinator ...... Do you have that in you? Are you willing to do it??

that's right the actual law had two words that could change the actual meaning of how they are supposed to do it (ie., vertical versus horizontal). Some people (i was one of them) thought that at such a stalemate in the words that coomon sense should prevail. Common sense would dictate that skill would prevail over diversity.
However; the rules were always such that there was never any horizontal spillover but rather vertical. The main thing that changed was that the unused visas from row could be used by retrogressed countries quarterly rather then annually.
That is why USCIS never published the regulations for AC21...They are sure as hell that their ass is gonna get sued...whatever regulations they propose... Now it is a miracle that no one has sued them....May be they are waiting for someone to sue them....

Yes everything is personal when you are so close to the effort. The answer is still the same for anyone that did not participate and find out for themselves what it takes to co-ordinate an event like this.
