I also joined the group in DC and wow! What a rush! I did not attend the 2007 rally and have regreted it ever since, so when Aman asked me to join this time around I was 100% ready.
Highlights:
1) The training we received on Sunday was outstanding, the IV core group is very experienced in lobbying our Congress folks, but they need manpower! So we were all there to learn and prepare.
2) Meeting so many people in my same situation was enlightening and uplifting, you could feel the energy in the room and a hundred people getting ready to change the world!
3) Monday and Tuesday were incredibly hectic. I figured out how to navigate the House and Senate office buildings sort of by the end of the first day, once you see all the tunnels you start to get the hang of it.
4) We met with staffers from Congressional offices from the west coast mostly and some from the east coast. Some of the were clearly our allies, some others not so clear, although many pedged to support our provision even if they would not support CIR as a whole for example. This was very encouraging.
5) DC was a buzz with tlka of the November elections and how that will affect the agenda for 2011, luckily we were there to start shaping it!
6) Several staffers were aware of our issues (thanks to IV efforts), but they still don't know the subtle details like per-country quotas, AC21 interpretations and other issues that impact us. That's why we need to reach out in DC as well as our districts.
7) Highlights were meeting with White House staffers and an actual Senator, I was very impressed. The Sen. was aware of our issues (although some confusion with H1B) but the staffers were very aware. I feel we really touched a nerve and made her realize the gravity of the situation for many.
8) We met with the Microsoft government affairs people in DC and the outlook was bleak, they were in full damage-control around the Sanders-Grassley ammendment that would essentially throw out visa and GC holders from companies that had done or needed to do layoffs. WE NEED TO ADVOCATE FOR OURSELVES! WE CAN'T RELY ON CORPORATIONS TO DO IT FOR US!
9) The reception on Tuesday evening was a great opportunity to meet other lobbyists that are our allies and discuss next steps and serve a s a capstone for a job well done.
Great work on organizing this IV! We all need to support IV so that these events can keep happening and our cause can gain more visibility!

Even if you assume there are 3000-5000 labor subs that chocks up the queue, it might have benefited the ones with a 2003 PD like yourself. But for others (beyond 2003) , it is not much of a help. A visa recapture would benefit the community at large.

Here is another story. My spouse has been working for the same firm for 7 years now. After finishing her Cost Accountancy in India, she received MS in Accounting and MBA in systems management from a top B-School in the US. Even then, her case was filed under EB-3, after a two-year wait because her company does not immediately process GC for newcomers. Her case went to the Dallas BEC for LC clearance in 2003. After that we haven�t heard a peep from the Dallas BEC. Her lawyers, one of the top law firms in the county, are not helpful at all. They wouldn�t tell us our case number so that we can check the status ourselves or tell us what they are doing to pursue the case. Apparently, the company has been burnt by employees who have left the day after getting their GC. Hence, the Law firm�s motto is mum and the HR department in the company is not doing very much to assist. Besides assuming that miraculously the LC is approved, the EB-3 for India is so badly retrogressed�well, we feel hopeless. Moreover her company has a bond agreement, if anyone leaves before completing 2 years of full-time service after receiving the GC they have to pay a fine of 10 grand. Her job involves extensive travel, which is really putting a strain on our family. However, we are in no position to change jobs, even within the same firm. I can apply, but then, it is another 6 grand for processing and I will be way back on the line, and the standards for EB-1 is so exacting and the paperwork required is so daunting that it will take months to get all the paperwork and letters together. And, my school is not very enthusiastic about sponsoring people under EB-2. Anyway, what�s the point of filing under EB-2 now?

I just talked to a NSC representative and he told me that my case is sent to extended review. Now what is this extended review?
Well, what annoys and confused me is that when I took Info pass day before yesterday she told me that my case is with IO. And now NSC rep is giving me another version called extended review.
Don't know whom to believe.
Does anyone here had same exp.
I talked to a TSC rep a couple days back and she told me that my case is under review. When pressed what it meant she told me I have to wait for some more time before action is taken on my case:confused:

I thought I will share this. Not sure if its going to help anyone.
Approached the entry counter where they give you token to inside and talk to IO. Surprisingly the person at the entry counter had IO written on her badge that she was wearing. She asked me reason to visit. I told her that I applied for my I-485 and have been current for this month , but have not heard anything. She asked if I was EB2 or Eb3. I told her EB2. She asked for receipts. I gave her 485 receipt and copy of I-140. She then compared my PD with copy of August Visa Bulletin. After she confirmed that I was current, she told me that my case is assigned to IO. I don't think she even entered my A# or receipt number. But I am not sure about this part because I dont remember the exact sequence of events. Anyway, I asked her whether my NC is clear. She then entered something in the system and told me that my NC was clear only last month and thats why my case has assigned to my IO. But this time she told me it was assigned on 8/8/08. She told me I should hear something soon. Did not and was not ready to give any time line. Also she did not mention anything about visa numbers being exhausted. If this had been the case she could have mentioned that.
After that I asked if everything else was clear, she mentioned without even looking at the system that everything is clear and I should hear on my case soon.
I dont know about rest of the stuff but I know that at least the NC info is consistent with the call I made to TSC few weeks ago. So I can at least believe that my NC is clear.

I know a lot of people have advised you not to go to the cops but I feel ( I have a young son ) that you should not let anyone who beat your 8 month old kid go unpunished.
I am not a lawyer but from what I have seen about this country justice is not denied . Local cops and Immigration are two separate branches of government . ( ICE enforces immigration issues )
If anyone had beaten my son then my H1b or GC or citizenship would be the last thing on my mind. My opinion - take advise from the lawyer right away.
You have made some mistakes by not checking for the nanny's references and other things but would you let her go scot free just so that she can do it to someone else's kid and maybe cause permanent harm the next time ??
I agree. You should take the advice of a lawyer first. Local cops and immigration are seperate branches. When you report a crime, in my opinion, the cops don't ask you for your immigration status before starting their investigations. Even if they do, they are not going to tell the immigration that a person on H-1B has hired someone who is not authorized to work. It is best to see an good attorney who might change you couple of hundred dollars only.
As hpandey said, the reason she continues to work is because she continues to find jobs with people who are looking for Indian nanny and most of such people are willing to look the other way when it comes to nannys immigration status because the nanny charges less or maybe because the nanny speaks your local language and apart from taking care of your kids also cooks for you while you are out working. If you report her to the cops it will make sure that she and others like her never do such a thing again. It will send a message to all such unauthorized workers to stop misusing their immigration status. Also, you might be able to save other children from similar trauma.

I applied for my 2nd visa extension (1-year extension) after completion of 6 years in the middle of March 2007 (before I-94 expiry). My I-94 expired in the middle of March. I didn't hear from USCIS until the middle of July when they sent a huge list of request for evidence regarding my case (although I've been working on the same company's H1s for last many years now).
Meanwhile, I applied for adjustment of status on July 2nd as a beneficiary on my wife's application. If my H-1B gets rejected after sending the request for evidence for some reason now will I be out of status? Since my 180 days from my last valid I-94 will expire in the middle of September, is it a good idea to go on H4 before the middle of September and reenter the country?
In worst case, what will be my status if USCIS gets back to me, say in October, and says my H-1B extension application has been rejected?
Any input from UN or other gurus is appreciated.
Since you're a beneficiary of you're wife's AOS, you're in "pending status of authorized stay". Therefore you *are* authorized to stay here as of that day until a decision on the 485 is made (the unlawful stay clock stops ticking). If you get rejected on your H1 extension, you can still stay in the country and possibly work on the EAD (a derivative benefit of the 485). If you think your wife's 485 is airtight, and there's a problem later you can use the 245(k) provision since you were in unlawful stay for less than 180 days.

1. Why do we put up with the inefficiencies of the American Govt?
2. Why do we sit down and accept what is given to us instead of asking for what we want/ desire?
3. Why do I hear - "I am not interested in protesting" or "I don't have the time" from folks that are paying a high price due to retrogression?
We are LEGAL, tax paying, resident aliens that are contributing to the economic growth and not siphoning off government funds. Don't we deserve better?
Why were there 100's of thousands of faxes sent by NumbersUSA (aka Sherman and gang) while all we could muster was a meager 20000? Where are the rest of the 1.2 million EB applicants?????
Its time we stood up and showed them our strength. We have the numbers- we just need the strenght and courage to stand up for our convictions.

I think that the IV core is aware of this campaign. They are not against it, as far as I understand, though obviously, there is no direct endorsement from them either.
I think this is a great idea to get media attention - something different and unique, and media always loves these things. The only thing that can doom it to failure is lack of enough numbers.
If we go and tell a journalist about this campaign, the first question we will be asked is, "how many flowers are you talking about?" and if our answer would 50 or 100, then the story dies right there. 250,000 affected skilled immigrants and only 100 of them are enthu enough to send flowers - well that's no story :rolleyes:.
So the only thing I can say is that at worst, this action will do you no harm and you will be out of 30-40 dollars. But at best, this can give us a media spotlight - and I think it is worth it.

I heard from a friend who has a brother working in one of the lawyers affiliated with the AILA that USCIS has issued an internal memo to "go slow" on all EB 3 petitions including EB 3 I. That is very confusing to me given that EB3 I is U on the May VB. Has anyone else heard about this? if so can the IV core take measures against this discriminitory move.
Well - at the end of the fiscal year - their goal is to exhaust the quota. They have to exhaust the quota and they figured out that they have old EB2 approvable cases. As long as they exhaust quota it literally means there is demand - there is nothing much we can do - we are just stuck.
I request the entire community to unite and do something for ourselves. Admin fixes in form of preadjudication and recapture in form of legislation. Unless we do something for ourselves, as time passes - things will get more tough for us.
