Thunderbold, Sorry for your situation. Here is my observation/suggestion.
Being an immigrant you have broken the law by hiring someone to work illegally. Didn't you and your wife break the law?
You have already witnessed a child abuse and now pondering whether to report this to a law enforcement or not. Again you are breaking the law by not reporting a child abuse. Remember, abetting a crime is also a crime.
This country has given us so much including good wealth and health(except GC) and we enjoy every thing, but in return what we do is to do these kind of illegal activities.
This country let us and our spouse to work, make hell lot of money. I am not saying we are making easy money, but after having two incomes, we run around with coupons and look for cheap things or do things that are cheap. WHY?
What are we going to do with that money man? This is nothing but a greediness.
Anyway, your child has gone thru a nightmare and as a parent/father you MUST report this to a law enforcement office. You can not let this child abuser go scot-free.

I am working with the same company for the last 5 years. Completing 6 years on H1 here and the attorney decided to file for LC couple of days before the old system was to come to an end.
I hold a Masters degree in Engineering but I came to know later that they filed the petition in EB3 category.
I have been waiting for over an year to file the PERM petition because first I wanted to get my 7 th year H1 extension using the old petition.No clear guidance on multiple filing of petitions is creating lot of confusion for people who are in the 6 th year of H1 status.
Just before retrogression started, got a chance to substitute labor with another company but I could not forego my permanent position/bonus for the chance to get GC sooner and so decided to work with the same company.
Now my company may close in the next 1-2 years and I will have to start my GC process all over.Even after working here for 6 years with the same company, there is no portability of the process. It is the individual who wants the GC and the Govt should decide to give this.
You have employer/attorney in between who are greatly benefiting due to the helplessness of the employee and the careless attitude of the Govt.
I still want to believe that the system will be fixed and people will be treated fairly.
I am in the final phase of getting my Canadian PR card and I do not want to entirely pin my hopes on getting a GC here.
It is unbelievable how this country which encourages people to play by rules has such a broken immigration system.

This person's company promoted him to IT Manager with huge hike and then he learnt from company attorney that he cannot change his role while his LPR is in process. He then got demoted to Sr.Software enginner from IT Manager and the hike was rolled back

I decided to move to india now. I have I140 cleared and having a permanent job. But enough is enough!

I need to add my daughter's last name to I-485 and subsequent AP. Do I still need to have US court order for doing the same once her passport has correct last name ? How much time does the US court order take and what is the cost ?

That memo could be correct but the EB2 approvals that are happening now are the based on the visa numbers left over by ROW in EB2 and EB1

As gc_check explained, all EB2 with PD<2007/7 will get the green card 2 years earlier if this can be fixed. I do not understand why IV can not discuss it with USCIS.

it goes deeper than that. first let me point out that this is philosophical- you argument is not about law, it's about a point of view.
so if i ask you why EB2 filers should spend extra years getting educated and never getting this all important magic "PD" and then get in line behind someone who got a job the day they entered the country- and got a PD soon enough- what would you say?
ask me. it took me 11 years to get a PD. why? for 7 of those years i was getting my advanced education. so why should i suffer behind the 3 year Indian degree person (against my 7 years there as well) who came in 5 years after me and filed right away?
there are reasons why the EB priorities were set up. by simply extending your logic EB1 should also wait for a turn and not have priority. what's good for the goose....
having said that, it is absolutely insane to ask people to wait indefinitely and we must do something about it.
today the EB3 folks (and I have nothing against them, their waits are insane- and it's absolutely not right) are porting to EB2 with those bachelors degrees and 5 years experience. and just because they could APPLY for a GC earlier and all their years get counted in the PD, they keep lining up ahead of me. why do all my years count for NOTHING?
please spare us "fortunate" EB2s a thought too. think of when in life our careers are finally freed from waiting for a GC.
and now please concentrate on ways to end retrogression and stop the EB2 vs EB3 crap. we all have our problems.

1. Let EB2 be wonder kids. All I am saying is their GC shouldn't be at the cost of EB3. Have a separate quota which is twice as much as EB3. But, when the left overs are up in the air, EB2 shouldn't grab everything.
2. Not all EB3 are with 3 years Indian degree. Most of them are 4 years and above. Please prove me wrong. There are several Master degree holders in EB3 queue just because of their employer decision (not even job requirements).
4. Most people filed under EB3 way back in 2001/2002 because they didn't antici pate such a mess 5-6 years down the road.
5. Today most applications are EB2? How? does it mean that the '3 years' Indian degree holders are not coming to US anymore? Nope. These days people just ', manage' to file under EB2.
6. Finally, EB2 would understand what we (EB3) are saying if the EB1 queue was retrogressed and EB2 was stuck in 2001.
There is no separate quota while applying for H1B but at the final stage of GC! Ridiculous!!
Bottom line, a VISA that could impact an individual's life so much should not be dragged for 7-8 years. And, thank you for your concern for EB3.

Chanduv23 First - let me say I respect your outstanding and active contribution on this forum very much. Having said that, I'd say, you both conveniently missed the point in my post.
I am not arguing about who is ahead in the line to get the non-existent cake - please read my post once again and point it out to me where I said anything in such regard..
Frustration comes from the point that all the discussions take tone that all IV efforts are to help EB2 category alone. It is becoming frustrating for EB3s to keep reading posts and participating in actions when everyone keeps portraying IV effort as EB2 only effort.
I'd request you both to please read my post again.
All I have said is that message need to be made stronger that IV effort is for all EB community.
By responding with who's ahead in line type of comment you both are just ignoring the situation that already exists as of today on this forum wrt EB categories. I'd venture to say that if at all you're making that feel of eb3 left out even worse than it already it.

Just got back to from DC and back to work. In a nutshell, it was amazing to relive the 2007 experience and reconnect with the dedicated IV members and Core team.
