Visas are divided equally -country wise quota - no country can have more than 7% of worldwide quota. Countries like India, China, Mexico, Phillipines that have more professionals in the USA. So these countries get retrogressed. EB(Employment based) greencard applicants from these countries have to wait.
Rest of the world (ROW) EB2 (ROW) do not have to wait, their dates are current.

Hi, I am applying for a re-issue of passport to split my given name into Surname and First name (NO spelling changes.. just the name split).
1) While filling the online application form, what do I need to fill in "Other Address" field? Is it my residence address in the US OR can it be same as the permanent address in India?
2) How do I indicate my mailing address to the consulate to ship the passport back to me? (I stay far from NYC and I am planning to apply for new passport via FedEx).

Please dear god..... let them consider priority date instead of the notice date. Mine is Oct 15th 2007. Our priority dates were current for three times and our application never touched, all our friends March 2006 to Jun 2006 filers got their cards a couple of years ago....:rolleyes:

Please see one of the replies I have above in response to another post. You employer could not pay you, but it is not your fault. If a RFE comes up, you can file affidavits to that effect. You have to consult a good lawyer.
If you are not going to be leaving the US, you shouldn't have to worry about the H1 stamp because you should be getting a new I-94 with your H1 extension approval notice.

Ok, so if I file the i-140/i-485 now and leave the country with a new stamp.
what do you mean by new stamp ? once you apply for I-485 , you need to wait until you get your I-485 reciept# to leave country.
Now, if my I-140 is approved after that, and then my i-485 is looked at after that date, will I considered to be in status then, because when they are looking at the AOS application, I have already left and returned to the country??
I guess you have to get new I-94 and submit that new I-94 to USCIS.
Or should be in status the day the AOS petition is filed and even if i leave/re-enter the country after that, it does not matter?!

Yes, I have applied for H1-B under master's quota PP on the 3rd of April but have not recd any receipt notification...don't panic am sure we will hear something in the next 2 weeks...

Your concerns about the per country limit will seem as useless bitching for ROW group in the similar way you see complaints from EB3.

Visa number is only "assigned" after all kinds of review and background checks are done. This is by far the last step in the wayward journey.
In other words your LPR status is registered only when the visa number is received from DoS. So pre-assigning of visa numbers while review continuing in the background is simply not possible !
Bottom line is getting VISA number assigned to file when current, and let them complete review at later time, once File has VISA number then its ready to for approval.

When did you get your GC?
I had to be persistent with my complaint with the Ombudsman. Finally I got it later in the year. When I sent my complaint in, sometime in July 08, I thought I was among the few who were left out. But this thread suggests that there are a lot who were bypassed when they gave GC's to PD's in 2005 and 2006 last year.
