Well, you did not give your easy example, nothing about affirmative action, nothing about representation or overwhelmed by Indian and Chinese thing, and absolutely nothing about preferential treatment. And while you "hinted" that we are all equals, you did not say - if we are all equals, then why should there be PREFERENTIAL TREATMENT for one group of people over others, unless someone is still practicing APARTHEID. Sanju, I did not promise to give you any more examples - easy or otherwise. People have made up their minds, and arguments against the stand devolves into character assassination. While I myself dont care about the dots, and seeing that the discussion started off, at least in part, about unscrupulous distribution of dots, I find it very ironic that I am getting insulting words thrown at me. The point I am trying to make is that such an action will not be "fair" to people who are in queue (who rely on the 7% cutoff to get their GCs). If the congress makes changes to the rule, then people will have to live with it (fair or otherwise)... by the way, most rules are not made to be fair to everyone. But the thing is such action will have a negative impact on ROW, and it is a pity that many ROW dont realize it. They seem to blindly following IVs call of action. There is some saying about blind faith that escapes me at the moment, but the bottom line is that blind faith is a dangerous thing.
So am I escaping form expounding on my thoughts. Yes, and No. I think I have made succinct argument (based on the laws) as to why things are as such, so I dont see the need to argue further.

I read about your intense desire for GC and was thinking to myself... is GC something that someone has to be so very obsessed about? But after reading about your ordeal on this thread, I am starting to see why this is such a joyful time you in you life. Congrats!!! We are highly educated, skilled law abiding immigrants. Since we do possess diverse skills, we will be always welcome in Canada, Australia or New Zeland, and other similar pro-immigrant oriented countries. But we choose to stay here and make this country our home and make this country even greater for our children.
The process is not easy, and we have a unique opportunity to get something accomplished that will not only affect us but everyone who comes after us.

I would strongly disagree that H1 = cheap labor. It's only the H1B employer who pays low salaries, where as the client pays the same billing rate to all contractors (including US citizens).

I am EB3-India, yet I dont support the removal of per country limits, as there is a reason for the diversity rule, Indians and Chinese are currently on the wrong side of the equation so it seems "fair" to remove the quota.

If rules weren't meant to change, why have the fricking senates, parliaments and elected officials?? All we need is one court to run the whole country.

Couple of my friends, who have 3 year degrees from India and also have 2 year Masters degree from India, have not been able to apply for EB2. Their lawyers suggested that 3 year degree are a hindernace to get EB2. They both have not tried applying for EB2 and both have active EB3 applications.

(1) EAD -To have the remaining of H1 as back up: If I use EAD and move to the new employer and also send AC21 documents to USCIS. My current employer will cancel H1 and revoke approved I-140. Also looking at the current scenario if USCIS denies 485 within a couple of months how do I get back to H1-B ASAP while I file MTR?
(2) H1 - Maintain H1 and use AC21 with H1 transfer(I will have around 9-10 months of H1 remaining at this point of time): And if current employer cancels H1 and revokes I-140 and that triggers 485 denial, I will still have some H1 period remaining and this should aid me in CONTINUING the new JOB while I file MTR?

One of my friends(who was in my company earlier) got his old H1 case reopened. He is not that worried as he already has left the employer and joined someone else.
This is little strange as USCIS is digging the dead.
I am keeping a close eye on my case which got approved in 03/2005 and has LUD of 08/2006. Seems like they opened the case earlier but I didnt notice it.

Yeah, we have to focus on long term relief. Getting AP and EAD is not a long term solution. I was hoping 'capturing unused numbers' or something better would happen with this July fiasco fix, does not seem to be happening now.

Guys, on a side note, please be aware that while you are residing/employed in the US and you pay and file tax returns for your employment in the US, per US laws/regs you have to pay taxes on your "worldwide income". Now there is a dollor for rupee tax credit, but assets taxed in the two countries differ and their rates differ too. So if you buy property in the India while in the US you may need to declare it or any rental income you may receive from it on your US Tax Returns while you continue to reside/work in the US.
It is pretty complicated and you will need the services of an International Tax Accountant.
