I dont think companies are really geared to file for 140 within 45 days of labor approval...
The condition is not for "to file 140 within 45 days of labor approval"
But it is for the company to substitute the LC for some other employee.
There is no time limit set to file I-140 for the employee for whom the LC was issued.
AILA opposes this 45 days condition on the premise that they can not find and recruit a person to apply LC substitution within 45 days.
Anyway it is good to see majority of the "LC-jumpers" will be stopped.

Finally I am a US citizen after being 10+ years in this country. This is one of my biggest fulfillments and it means everything to me. US is just not home anymore for me, it is my country.
I wish everyone the best and hope they get GC very soon.

I recently went to South Korea and entered the US on the AP since I didn't feel that I had enough time to wait for my H-1B stamped in my passport at the US emabassy in Seoul. Before leaving the US, I consulted with my attorney on this issue and she assured me that my H-1B is valid as long as I file the extension and maintain terms of the H-1B visa.
This is her opinion in quotes:
"I wanted to emphasize that you do not need to obtain the H visa as long as you have an unexpired Advance Parole document to use instead. To clarify, you are then entering in parolee status but in later filing an H extension or change of employer petition, DHS will terminate the grant of parole and admit you back into H classification. Additionally, if you enter on the advance parole and work consistent with the terms of your underlying current H petition, you are not violating your status nor do you need a separate EAD work card."

As your lawyer used the words "change of employer petition", it seems that one can use AP to travel and still after coming back he/she can file for either extension, amendment or transfer. This answers the main concern that I started this thread for.
Also, on other threads I read that its possible to file H1 amendement even if your H1 is still valid. This is one way to come back to H1 status and get a New I-94 card.
Some one also mentioned that if you have a valid I-797 extenstion approval notice and if you show that at POE to IO, he/she may issue an I-94 till expiry of I-797 (3 years) instead of AP (1 year).
I would appreciate input from others who have some knowledge or experience of above situations.

Under the list of DOs, once you have GC,

I believe after this new fees, we might have to pay one more time for the renewal and after that we never have to pay for any renewals. So it will not be a factor any more.

Post doc is a position not a US educational qualification and hence not a benefitiary of SKIL bill. The SKIL bill included US Master's and Ph.D's.
With your US MS you should not have any problem. Would require 3 years work experience to allow one to self adjust. We will need to wait and see what happens when it is introduced again in the new congress.
I hope USCIS has your thought process. Your thought process means that there is something in SKILL for US MS. I used to think that SKILL is only for non US MS.
Have you seen SKILL? Does it have anything for US Ph D and Post doc? You can have a US Ph D without US MS and you can be US post doc without US Phd? I wonder if they are SKILLed? Thanks.

The stats you are refering to are total I485s. They include FB, Asylum etc. You are missing our China friends. They may have atleast 100K apps pending.

Here are the few main reasons for retrogression to India and China etc are
1) When H1B quota is 65, 000 the GC visa number is 140, 000 . But when they increased H1B from 65,000 to 195,000 the did not incresed GC visa numbers.
2) There is no country quota in H1B ( other than Chile and one more country for 7,000) visas. So most of the H1b's are issued to few countries like India,China and Philippines. But when we come to GC visa there is country quota.
3) We all know about that ilegal immigrants used some GC numbers which are meant for EB people.
We need to educate the USCIS why and how we are suffering in getting GC.
there is no need and use of blaming Desi companies. I do not support any illegal activities like sale of Labour certifications .
We all know about supply and demand theory which causes black marketing.
Selling of approved labour ( which has old PD ) is also same thing.
